There are cases where yes, parents have been overfeeding their children to a massive extent and in some cases, children have been taken into social services because they've taken it too far, but as for the majority it's both the fault of the parents for providing such crappy food and the child for being lazy (though this could be due to the parents raising also). To mean that obesity is child abuse, then you'd have to take away all (non-medical) obese children to avoid hypocrisy. You realise how much money that would cost if the government took away that many children based on the grounds of child abuse?
Also, why under 13 for child abuse? Pretty sure until you're 18 you're viewed as a child in the eyes of the law.

Under 13 because I wanted to aim this thought at those under 13.
And you are how you've been raised. If someone is lazy then it's the parent's job to sort it out because they are responsible for that child's health.
